What is the UK Spouse Visa?

The UK spouse visa allows applicants to join their partner and live in the UK for two and a half years. If you are successful, you can gain entry clearance into the UK and work there on this visa. However, as the non-British partner, you will have no access to public funds or benefits that UK citizens are entitled to.
You can apply for a Spouse visa from inside of the UK where you will most likely be switching to it from another visa route, or you can also apply from outside of the UK.
The application for this visa route is long, daunting and complicated so it is advisable to seek advise from an immigration lawyer UK when putting together your application.
You must meet some basic initial requirements when applying for this visa route.
-You must be married to British Citizen
-Or you are married to someone that has the status of indefinite leave to remain, settled status or permanent residence in the UK
If so, you can submit your application and if successful you will be granted entry clearance into the UK for 2 and half years after which you can re-apply with the intention to gain indefinite leave to remain in the UK after 5 years.
Before submitting your Spouse Visa Application, you will also have to show that:
-Both you and your partner are over the age of 18
-You (as the applicant) speak and understand English. For this, you will have to prove that you have studied English to an adequate level or may have to pass an English language test
-Your UK spouse is either a British citizen has indefinite leave to remain, settled status or permanent residence
-You are legally married or in a civil partnership that is recognised by the UK
-You are in a genuine relationship and you will be living with your partner upon arrival in the UK
-You have met your partner before and this is not only an online relationship.
-You will have accommodation in the UK and for yourself and your dependents.
-You can maintain a level of living in the UK that is adequate and will not need to claim any public funds.
-You have been tested for tuberculosis by a Home Office approved clinic
Spouse Visa 5 Year route to Indefinite Leave to Remain
If you are successful in your application for a UK spouse visa and manage to renew your application and remain in the UK for 5 years, provided you meet all of the criteria, you could be entitled to recieve the status of indefinite leave to remain (permanent residence) in the UK.

Spouse Visa 10 Year route to Indefinite Leave to Remain
If you do not meet all the requirements under the 5 Year Route – Spouse Visa you can apply under the 10-year route (only from inside the UK). Applications through this route are mainly made by those who do not have the financial requirement, immigration status or English language level to succeed under the 5 Year Route.
